Terms of Use

1. Entertainment service

Roastagram is an AI-powered entertainment and commentary service.

The Service analyzes supported publicly accessible Instagram posts and Reels and generates humorous, satirical, critical, subjective or exaggerated commentary commonly referred to as a "roast."

Roastagram is intended for entertainment only.

Roast results:

• may be inaccurate;
• may be incomplete;
• may contain subjective opinions;
• may contain sarcasm, exaggeration, jokes or offensive humor;
• may misinterpret a person, image, caption, context or intent;
• are generated automatically and are not statements of verified fact;
• do not represent the personal views of Langugo LLC or its personnel.

You should not rely on a roast result as a factual assessment of any person.

2. Age requirement

You must be at least 18 years old to create an account, purchase the Service or submit content for roasting.

You may not knowingly use Roastagram to target, humiliate, sexualize, harass or otherwise harm a minor.

If we reasonably believe that submitted content involves a minor in an inappropriate, exploitative or harmful context, we may refuse processing, remove results or suspend access.

3. Public Instagram content only

Roastagram is designed only for supported Instagram content that is publicly accessible at the time it is submitted.

The Service is not intended to bypass Instagram privacy settings, authentication controls, access restrictions or technological protections.

Private, deleted, unavailable or unsupported content may not be analyzable.

Availability of a post on Instagram does not mean that Langugo LLC owns that post or that the post is free of third-party rights.

Instagram and Meta are independent third parties. Roastagram is not affiliated with, endorsed by, sponsored by or operated by Instagram or Meta Platforms, Inc.

4. Your responsibility when submitting a post

You are solely responsible for every URL and item of content you submit to Roastagram.

By submitting a post or Reel, you represent and warrant that:

• (a) the content is publicly accessible;
• (b) your submission and intended use of the resulting roast are lawful;
• (c) you will not use Roastagram to stalk, threaten, intimidate, harass, defame, impersonate or unlawfully target another person;
• (d) you will not submit content for an unlawful, exploitative or abusive purpose;
• (e) where permission, authorization or another lawful basis is required for your intended use, you have obtained it;
• (f) your use of the Service will not violate another person's privacy, publicity, intellectual-property or other legal rights; and
• (g) you accept responsibility for how you use, distribute, publish or communicate the resulting roast.

5. Roasting friends or other people

Roastagram may allow you to submit a public post belonging to a friend or another person.

This feature does not give you permission to harass or unlawfully target that person.

You are responsible for considering the circumstances, your relationship with the person, the nature of the content and the manner in which you intend to use or share the roast.

Do not use Roastagram to:

• conduct sustained or coordinated harassment;
• encourage others to attack an individual;
• threaten violence;
• reveal private or sensitive information;
• shame victims of crime, abuse, illness or tragedy;
• attack someone because of a legally protected characteristic;
• create sexualized commentary about minors;
• facilitate stalking or intimidation;
• falsely represent AI-generated commentary as verified factual information.

Roastagram may refuse, limit, remove or disable content or accounts where we reasonably believe the Service is being abused.

6. AI-generated output

Roastagram uses automated systems and artificial intelligence.

AI-generated content is probabilistic and may produce unexpected, incorrect, offensive, inappropriate or nonsensical results.

We do not warrant:

• accuracy;
• factual correctness;
• completeness;
• suitability;
• non-offensiveness;
• originality;
• non-infringement;
• consistency between separate analyses.

Scores, verdicts, personality-style observations and other assessments are entertainment outputs and should not be interpreted as objective measurements or professional conclusions.

7. No professional advice

Roastagram does not provide medical, psychological, legal, financial, employment, educational, reputation-management or other professional advice.

Do not make important personal, professional, legal or financial decisions based on a roast result.

8. Sharing roast results

Roastagram may provide tools that allow users to share roast results through a unique URL, share card or third-party social platform.

Roastagram does not operate a public Roast Wall or public directory of all user roasts.

You decide whether to distribute your roast result or share link.

If you share a roast result publicly, anyone who receives or discovers that link may be able to view it.

You are responsible for:

• choosing whether to share it;
• the audience with whom you share it;
• complying with applicable law;
• respecting the rights of the person whose post was roasted.

We may disable or remove a shared result where appropriate, including following a valid legal, privacy, intellectual-property or abuse complaint.

9. Reporting abuse and requesting removal

If you believe a Roastagram result concerning you:

• violates your rights;
• contains personal information that should not be displayed;
• infringes your intellectual property;
• constitutes unlawful harassment;
• or should otherwise be reviewed,

you may use Roastagram's Report Abuse, Data Removal or Contact pages.

We may review requests, seek reasonable verification and remove or restrict content where appropriate.

Submitting a request does not guarantee removal where continued processing or retention is permitted or required by law.

10. User accounts

You are responsible for:

• providing accurate account information;
• maintaining control over your account;
• safeguarding authentication credentials;
• activity occurring through your account where legally attributable to you.

You must promptly notify us if you suspect unauthorized account access.

We may suspend, restrict or terminate accounts that violate these Terms, create security risk, abuse the Service or engage in fraudulent activity.

11. Free roasts and usage limits

Roastagram may provide a limited free roast or other promotional usage.

Free usage is offered at our discretion and may be subject to technical, device, browser, account, network, anti-fraud or other controls.

Attempts to evade free-use limitations, create abusive duplicate accounts or manipulate promotional limits are prohibited.

We may modify or discontinue free-use programs at any time.

12. Subscriptions

Roastagram may offer recurring subscription plans.

Current plans may include, for example:

• Monthly subscription: up to 30 roasts per applicable monthly entitlement period.
• Yearly subscription: up to 360 roasts per applicable annual entitlement period.

The exact price and entitlement shown at checkout at the time of purchase controls.

Subscriptions automatically renew for additional periods unless canceled before the applicable renewal date, subject to applicable law.

By purchasing a recurring subscription, you authorize the applicable payment provider to charge the payment method associated with your purchase for recurring charges until cancellation.

You may cancel through the available billing/customer portal or other cancellation method provided by Roastagram.

Unless otherwise stated or required by applicable law:

• cancellation prevents future renewal;
• cancellation does not retroactively cancel charges already validly incurred;
• access may continue through the end of the paid billing period.

13. Extra roast packs

Roastagram may offer one-time additional roast packs.

The quantity and price shown at checkout controls.

Extra packs are digital entitlements associated with the applicable account and are not cash, stored value, cryptocurrency or transferable financial assets.

14. Prices, taxes and payments

Prices may change from time to time.

A price change will not retroactively alter a completed one-time purchase.

Changes affecting recurring subscriptions will be handled as required by applicable law and the applicable payment process.

Payments are processed by third-party payment providers, including Stripe.

Roastagram does not need to store your complete payment-card number in its application database.

You agree to provide valid payment information and authorize applicable charges.

You are responsible for applicable taxes except where we are legally required to collect or remit them.

15. Refunds

Because Roastagram provides digital services and AI processing that may be consumed immediately, payments are generally non-refundable once the applicable service or entitlement has been provided or used, except:

• where required by applicable law;
• in the case of a verified duplicate or unauthorized charge;
• where Roastagram expressly approves a refund;
• or where a mandatory consumer right applies.

Nothing in these Terms limits statutory consumer rights that cannot legally be waived.

16. Prohibited use

You may not use Roastagram to:

• violate applicable law;
• infringe intellectual-property rights;
• invade privacy or publicity rights;
• harass, threaten or stalk;
• facilitate discrimination or unlawful hate;
• target minors in a harmful or sexual context;
• publish someone's private contact, financial, health or identifying information;
• generate fraudulent endorsements or impersonations;
• deceive others into believing an AI-generated statement is verified fact;
• conduct automated abuse, scraping or attacks against the Service;
• probe, bypass or defeat security or usage limits;
• interfere with Service infrastructure;
• reverse engineer the Service except where such restriction is prohibited by law;
• resell access without authorization;
• use stolen payment credentials;
• create accounts for fraud, quota evasion or abuse;
• submit malware or malicious code.

17. Intellectual property — Roastagram

The Service, software, interfaces, branding, Roastagram name, logos, designs, templates, scoring systems and other proprietary materials are owned by or licensed to Langugo LLC and are protected by applicable intellectual-property laws.

Except for the limited right to use the Service, no rights in Roastagram intellectual property are transferred to you.

18. Third-party content

Instagram posts, images, videos, captions, usernames, trademarks and other third-party material remain subject to the rights of their respective owners.

Roastagram does not claim ownership of third-party Instagram content merely because it is analyzed by the Service.

Your submission of a URL does not transfer ownership of the underlying Instagram content to Roastagram.

19. Roast outputs

Subject to these Terms and applicable law, Roastagram permits you to use and share roast outputs generated for you for lawful personal or commercial purposes.

Because outputs are AI-generated:

• similar or identical output may be generated for other users;
• outputs may not qualify for copyright protection in some jurisdictions;
• Roastagram does not guarantee exclusivity or ownership;
• you are responsible for ensuring that your particular use is lawful.

20. Copyright complaints

We respect intellectual-property rights.

Copyright owners or authorized representatives may submit copyright-related complaints through the Contact or Report Abuse mechanism available on Roastagram.

A notice should contain sufficient information to identify:

• the copyrighted work;
• the allegedly infringing material;
• its location on Roastagram;
• the complaining party;
• a good-faith statement concerning the claim;
• and any other information required by applicable law.

Where applicable, we may remove or disable access to material and may respond to valid counter-notifications.

Nothing in this section represents that Roastagram has satisfied every requirement of a particular statutory safe-harbor regime unless those requirements have actually been completed.

21. Third-party services

Roastagram relies on third-party infrastructure and service providers.

These may include hosting, database, authentication, payment processing, email delivery, security, analytics, advertising measurement, AI inference and social-media services.

Third-party services may experience outages, errors or changes outside our control.

Your use of third-party websites or services is also subject to their applicable terms and policies.

22. Service availability and changes

We do not guarantee that Roastagram will always be available, uninterrupted, error-free or compatible with every Instagram post, device, browser or jurisdiction.

Instagram or other third parties may change their systems, policies or technical behavior, which may affect Roastagram functionality.

We may modify, suspend or discontinue all or part of the Service where reasonably necessary.

23. Moderation and enforcement

We may, but are not obligated to, investigate suspected violations of these Terms.

We may refuse a roast request, restrict sharing, remove content, limit features, suspend an account or terminate access where reasonably necessary to:

• enforce these Terms;
• protect users or third parties;
• respond to legal requests;
• address fraud or security threats;
• prevent abuse;
• protect Langugo LLC.

24. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

LANGUGO LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY AND ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT ANY ROAST OUTPUT WILL BE ACCURATE, APPROPRIATE, NON-OFFENSIVE, ORIGINAL OR SUITABLE FOR YOUR INTENDED USE.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

25. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANGUGO LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, REPUTATION OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANGUGO LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

• (A) THE AMOUNT YOU PAID TO ROASTAGRAM DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
• (B) USD $50.

These limitations do not apply where liability cannot legally be excluded or limited.

26. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless Langugo LLC, its affiliates, owners, officers, employees, contractors and service providers from claims, liabilities, losses, damages, judgments, costs and reasonable legal fees arising from or related to:

• content or URLs you submit;
• your use or sharing of roast results;
• your violation of these Terms;
• your violation of another person's rights;
• unlawful harassment, defamation, privacy invasion or intellectual-property infringement caused by your conduct;
• fraudulent or abusive use of the Service.

This provision does not require indemnification to the extent prohibited by applicable consumer law.

27. Consumer rights

Nothing in these Terms excludes rights or remedies that cannot legally be waived.

If you are located in a jurisdiction with mandatory consumer-protection laws, those protections continue to apply.

28. Dispute resolution for U.S. users

Before filing a formal legal claim, you and Langugo LLC agree to make a reasonable good-faith attempt to resolve the dispute informally.

You may initiate this process through Roastagram's Contact page.

If a dispute involving a U.S. user cannot be resolved informally, then, except where prohibited by law and except for qualifying small-claims matters or claims seeking injunctive relief concerning intellectual-property misuse, the dispute will be resolved individually through binding arbitration rather than a jury trial.

The arbitration will be administered under applicable consumer arbitration rules of the American Arbitration Association or another mutually agreed arbitration provider.

Claims must be brought individually and not as a plaintiff or class member in a purported class, collective or representative proceeding, to the extent legally enforceable.

A user may opt out of this arbitration provision by notifying Langugo LLC through the Contact page within 30 days after first accepting these Terms and clearly stating the request to opt out of arbitration.

If any portion of this section is found unenforceable, the remaining enforceable portions remain in effect.

This section does not limit rights that cannot lawfully be waived.

29. Non-U.S. users

If you reside outside the United States, mandatory rights under the laws of your country of residence may apply.

Nothing in these Terms is intended to deprive a consumer of protections that applicable law makes mandatory.

30. Termination

You may stop using Roastagram at any time.

You may delete your account through available account/data-removal functionality where offered.

We may suspend or terminate access where permitted by these Terms or applicable law.

Sections that by their nature should survive termination, including intellectual property, disclaimers, liability limitations, indemnification and dispute provisions, survive.

31. Changes to these Terms

We may update these Terms when the Service, law or our practices change.

The current version and effective date will be posted on Roastagram.

Where legally required, we will provide additional notice or obtain additional consent before material changes take effect.
